Jackson's point and you cannot ignore it is that THE FEDERAL COURTS ARE NOT ELECTED, LIKE STATE COURTS. ONE IS APPOINTED TO A FEDERAL COURT BY THE PRESIDENT and approved by the Senate. For a long time Senators were elected by the State Legislatures so during Jackson's time the Senate was not elected by the people also. Jackson was a populist who saw the Native Americans as a obstruction to the Settlers who wanted to stake their claims in the West. The Native Americans did not want the European settlers to take over their land, which is understandable, but the European
settlers (including my own ancestors) were escaping oppression in their own native countries and did not think about the rights of the Natives in the country they were escaping too. Hypocritical yes totally, but it was not illogical.
So, with all of this info and documentation, why don't the courts take action?
